LAW 2815 - Select Problems in Immigration Law: Crime, Deportation and Lawful Permanent Aliens


This seminar will examine the unique social and legal issues involved in the deportation of lawful residents convicted of crimes.  In the beginning the course will set out the historical and constitutional foundations of deportation and discuss removals on criminal grounds in light of their impact on the state, the individual, families, communities, and foreign countries.  Next the course focuses on grounds for removal, and examines in detail aggravated felonies and other offenses that can lead to deportation.  Relief from deportation will be discussed, as well  as retroactivity and detention.  The course will also provide insights into the practice in immigration court and on how the appeal process works.  Readings include law review articles and selected case law, but no specific text book.
