LAW 3924 - National Security and the Law


This course analyses the complicated legal issues surrounding the U.S Government’s response to the threat of international terrorism. Specifically, the course examines in detail the practical and legal ramifications of:

(1) law enforcement tools utilized to investigate and prosecute terrorists(such as material witness warrants, the Patriot Act, and the overall federal statutory framework),

(2) a terrorism defendant’s ability to obtain a fair trial

(3) the military’s approach to the detention of terrorists (such as conducting military commissions and designating enemy combatants)

(4) intelligence-gathering techniques (such as the Terrorist Surveillance Program, interrogations, and the Foreign Intelligence Surveillance Act).

These and other national security issues are debated and discussed by the class through the use of, among other things, case studies, trial exhibits, videos, guest speakers, and an in-class simulation at the end of the semester.
