LAW 2899 - Sex Equality in Transnational Perspective


This course is an inquiry into the present and possible relation between sex inequality in societies and legal sex equality guarantees around the world. The mainstream paradigm of legal equality operative in most statutes, constitutions and international instruments is examined. An alternative, drawn from law and theory in various jurisdictions, is developed. Comparative and international approaches to concrete issues, including comparable worth, sexual harassment, rape, gay and lesbian rights, abortion, domestic violence and pornography are explored together with U.S. case law on these subjects. Racism, class and culture are considered. The purpose of the course is to examine, criticize and expand the law of sex discrimination toward meaningful civil equality between women and men.
