LAW 2512 - International Financial Crimes


This 2-credit course examines and compares the prosecution of “securities fraud” in the United States, the United Kingdom, Germany, and Italy.  The respective statutes, key cases, and regulators shall be detailed and evaluated.  Both primary authority and commentary will be reviewed in the cause of selecting an ideal enforcement regime. 

The specific role of stock exchanges in forming and – in some cases – stalling regulatory enhancements shall be studied.  In particular, the relative advantages and harms of the criminalization of market abuses such as insider trading and stock manipulation shall be explored.
