LAW 2004 - Import Export Law


The terms “import” and “export” appear side by side in business.  In law, however, different laws govern each one.  Different agencies have regulatory and enforcement jurisdiction over each.  Different policies underpin each one.  Whereas all three branches of government play active roles in import law, export law is governed almost exclusively by the executive.

The import law topics we will cover include:  Admission of Merchandise; Entry Enforcement Actions; Record Keeping and Corporate Compliance; Rules of Origin and Tariff Classification; Valuation. 

The export law topics we will cover include:  the Commerce Control List (CCL) and Export Classification Control Number (ECCN); the Export Administration Regulations (EAR); the “deemed export” rule; “dual-use commodities” and the meaning of “subject to the EAR”; Record-Keeping Requirements (an overview).  Specially Designated Nationals, the Prohibited Parties list, Anti-Boycott Compliance Requirements are also included.
