LAW 2954 - Federal Criminal Law
This seminar examines contemporary issues related to federal criminal prosecution of conduct, primarily economic in nature, generally referred to as white-collar crime. This century has seen a dramatic increase in federal criminal enforcement activity regarding conduct alleged to have been committed by, or by individuals within, corporations, financial institutions and other large organizations. This seminar will explore related general principles of criminal liability as well as substantive crimes such as conspiracy, mail and wire fraud, securities fraud, commodities fraud, insider trading, false statements, foreign corrupt practices, money laundering and RICO violations. We will also explore issues involved with the sentencing of individuals and organizations, deferred prosecution and non-prosecution agreements, internal investigations, and cooperation between civil and criminal enforcement authorities.
