LAW 2796 - Law’s Response to Reproductive Technology


In this seminar, we will explore the legal and bioethical issues raised by reproductive technologies. Through case law, statutes and administrative law the course will cover new and older reproductive technologies including infertility, artificial insemination, surrogacy, gamete donation, in vitro fertilization, pre-implantation testing, genetics, cloning, gene editing and mitochondrial replacement. We will examine these and other areas through the legal doctrine of reproductive rights as they developed through substantive due process jurisprudence. Initially, we will study the line of contraception and abortion cases in order to create a foundation for further inquiry into reproductive technologies. An equally important part of the seminar will be developing an understanding of bioethical principles as they relate to reproductive technologies. While the principle of autonomy is central to understanding reproductive ethics, the concepts of beneficence, nonmaleficence and justice are essential to bioethical discourse in this area of medicine. Throughout the semester we will examine Issues of individual choice, privacy and access essential to understanding the challenges reproductive technologies pose, as well as how the social determinants of health, implicit bias and communication with providers disadvantage vulnerable populations.
