LAW 3612 - Elder Law Guardianship Practicum The Elder Law Guardianship Practicum offers students the opportunity to work in Hofstra Law’s Livingston Center for Children, Families, and the Law (“LCFFL”). Students will work on New York State’s Mental Hygiene Law Article 81 Guardianship proceedings. Article 81 was enacted to meet the complex and diverse needs of members of our society that due to their necessities and functional limitations, may need the appointment of a guardian for their personal affairs and property needs. Such appointments provide guardians with authority specific to the needs of the alleged incapacitated person.
Students will learn the substantive law of guardianship and gain practical skills in representing clients, research and writing, litigation skills, and courtroom decorum. Students will have the opportunity to help support a quasi-judicial function by conducting research and work towards a final report and recommendation to the Court. Additionally, this course will allow students to think critically about the current law and assess whether in practice, the law achieves its legislative intent.
