LAW 2873 - Insurance Litigation


This seminar covers the key components of the formation of the insurance contract, claims and the regulation of insurance business and insurance intermediaries. The course focuses upon how insurance law issues may receive different judicial/legislative responses in various jurisdictions. Public policy considerations underlying the law of insurance will be examined. Particular emphasis will be paid to key concepts such as the notion of “risk” and loss spreading. Students familiarize themselves with the core principles of the law and legal ethics relating to the conduct of insurance business and the resolution of insurance disputes; they develop their critical faculties by evaluating the rules, policies, and principles of insurance law and regulation; and develop their analytical faculties by identifying and resolving legal arguments arising out of insurance law disputes, and receive instruction with respect to litigation skills that result in the successful resolution of such disputes.
