LAW 3922 - Mediation Principles and Practice

Winter Intersession
This is an intensive skills training course conducted primarily during the January intersession for a class of no more than 24 participants. The course introduces students to mediation theory, principles and practice skills at a basic, generic level, and also addresses the specifics of family mediation practice (divorce, custody, etc.). The major part of the course is taught in an intensive six-day program, including lectures, discussion, exercises and simulations. In addition, there is a series of “case conferences” on four evenings during the spring semester, at which experienced practitioners present difficult cases from their own experience for clinical analysis. Attendance at the entire six-day program and at the four evening sessions is required for course credit.

Students gain a basic familiarity with the skills needed for mediation practice, skills that are also of value in many other areas of lawyering and client counseling. Students who complete the course successfully also receive certificates that qualify them to apply to work as volunteer mediators in any of the 50+ state-supervised mediation centers located throughout New York state.

The course is taught by Law School faculty members, assisted by experienced mediation trainer-practitioners. Course enrollment is limited, and the instructor’s permission is required. Preference is given to students who have taken one or more of the following courses: Alternatives to Litigation; Advanced Mediation Seminar; Negotiation, Mediation and the Family Lawyer; and/or Child and Family Advocacy: Litigation, Expert Witnesses and Alternative Dispute Resolution.
