LAW 3890 - Matrimonial Law Drafting Skills
Both transactional and litigation documents are essential to matrimonial law and are quite different than those involved in general civil practice and litigation. This course focuses on drafting both types of matrimonial documents. In litigation, the task is to create professional documents presenting you client’s case in a clear, articulate, and non-emotional manner, designed to convey the arguments persuasively both to your adversary and to the court. Transactional documents are also covered in this course, since they frequently become contested in matrimonial litigation. Students will draft documents which would be included in typical matrimonial cases, beginning with a retainer agreement, pendente lite application, orders to show cause, pre-nuptial and separation agreements, and stipulations of settlement. After review and critique, assignments may be rewritten.
Prerequisites & Notes
Prerequisites/Co-requisites: Students must have either taken the basic Family Law course, or be taking it contemporaneously with this course.
