LAW 3502 - Healthcare Compliance


This course prepares individuals with knowledge of a broad range of compliance issues in the health care industry, whether in a health law firm, government agency, or health care provider or research organization. Healthcare compliance is a vastly complex area of law, and this course is intended as a general introduction to the major sources of law. This course is not intended to dive deeply into any particular area, such as Medicare and Medicaid; additional follow-up or companion courses will provide a more narrowly-tailored view of such areas. However, since HIPAA and HITECH tend to dominate all areas of healthcare compliance, particular attention will be paid to those regulations

Classes (also referred to as modules) will address the major sources of healthcare laws, rules and regulations, including but not limited to HIPAA and HITECH privacy and security, the Common Rule, electronic medical records and signature requirements, bioethics, the Patient Affordable Care Act, and others. Other areas that will be briefly touched on include False Claims Act and whistleblower actions, the Sunshine Act, the European Data Privacy Directive, and certain state regulations, using New York State as a model. These statutes, rules and regulations will be analyzed through lecture and practical exercises, which may include drafting sample internal compliance policies and statutes.
