LAW 2852 - Methods of Int’l Comm ADR
The purpose of this course is to introduce students to the various methods of international commercial dispute resolution beyond the typical litigation venue, i.e., Negotiation, Mediation (Conciliation), and Arbitration (to include Mediation/Arbitration hybrids). Students will be familiarized with issues relevant tot he proper representation of clients before international dispute resolution institutions such as the ICC (International Chamber of Commerce), LCIA (London Court of International Arbitation) and the ICDR (International Center for Dispute Resolution), among others. Students will be required to undertake the typical steps for an international business transaction from the corporate counsel’s viewpoint to include identification of possible areas of dispute and to structure a complex contractual dispute resolution provision in response to such dispute identification. Topics such as forum selection, the role of local courts before, during, and after the dispute resolution, initiating the resolution process, and applicable evidentiary issues (where appropriate) will also be covered. At the conclusion of the course, the students will take part in internationally-based simulation resolution mechanisms where a multi-faceted dispute will be resolved pursuant to the three approaches to dispute resolution covered in the course.
