LAW 5803 - Mediation Clinic


Students in the Mediation Clinic will serve as mediators in actual cases facilitating the negotiations of parties involved in a conflict and helping them to make decisions about the conflict’s outcome. The mediations take place either at the Clinic offices or on-site at a referring court or agency. Under the Clinical Instructor’s supervision, students screen and develop cases; interview the relevant parties and counsel them on the use of mediation; mediate cases in two-student teams; and draft settlement agreements. In addition to the weekly seminar, students participate in training sessions on mediation theory, field observations, and simulated mediation exercises. The mission of the Mediation Clinic is not necessarily to train students to be professional mediators, but to teach them fundamental lawyering skills, such as interviewing, counseling, negotiation, and effective problem solving, all of which are essential to every attorney’s work. The course may satisfy Writing Requirement II. Registration by permission of the professor.

Prerequisites & Notes
Strongly recommended: Alternatives to Litigation, Advanced Mediation Seminar, or Mediation: Principles and Practice.
